Terms of service

General terms:
-Prices are subject to change based on demand.
-I have the right to reject any order for any reason.Process and delivery:
-The time it takes to finish your commission varies 1 week- 4 weeks depending on factors such as health, the complexity of the commissioned piece, and other work.
-Once the piece is finished you will receive the full-resolution image. Note that there is no physical product.
-In the cases of “Emotes” or “Badges” I may need your email to send the ZIP file with the content as this commission type has size variations.Revisions:
-You get 4 rounds of changes on the commissioned piece included in the price.
-A fee will be added if you want something changed on the final drawing. Unless a misunderstanding from my side has been made.
-If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want to make and is usually based on an hourly wage.
-If your reference is unclear to start with, changes will come at an extra charge.Copyright & usage
I Gloomy fuyu :
-I reserve the right to cancel and refund the order at any time for any reason.
-I retain all copyrights over the commissioned artwork.
-I will NOT claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc).
-I will NOT profit further from the commissioned artwork unless you (the costumer) break any of the terms.
-I reserved the right to post commissioned artwork online.You (the costumer/ commissioner):
-You may upload the commissioned artwork to any website and social channels.
-You may NOT make profits of the commissioned piece (reselling, redistributing, uploading to any POD-services, making prints for selling, etc).
-You may NOT alter the commissioned artwork without my (the artist) consent.
-You retain the right to the intellectual property (IP)
-You may NOT use the commissioned artwork for commercial purposes.
-You may NOT use the commissioned artwork for cryptoart purposes.
-You may NOT use any sketches/WIPs/unfinished or finished artwork for AI-related usage of any kindThe following is considered copyright infringement:-Reproducing/using the copyrighted artwork commercially- means making money off it in any way not excluded from these terms.
-Claiming the artwork as your own.
-Altering the artwork without my consent.In some cases, the commercial rights to the image can be purchased.Cancelation & refund policy
-The buyer is not allowed a refund once I start working on the commission.
-If for any reason I am unable to start your commission you will receive a full refund.
-If you cancel before I start it, you can get a full refund.
-The kill fee for canceling the commission after work has begun is 50% of the commission’s price. The client then receives the work as is.
-If the buyer wishes to cancel the commission after the work has started, the buyer can be issued a refund but agrees to pay the kill fee.Paypal specific:
-If you are getting a refund, do not request paypal chargeback. The platform let you get a refund requesting it in “need help?”
-If you request a Paypal chargeback at anypoint when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply paypal with our conversation in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

-Me reservo el derecho a cancelar y reembolsar el pedido en cualquier momento y por cualquier motivo.
-Conservo todos los derechos de autor sobre la obra encargada.
-NO reclamaré la propiedad intelectual (PI) de la obra encargada (sus personajes siguen siendo suyos, etc.).
-NO obtendré más beneficios de la obra encargada a menos que usted (el cliente) incumpla alguno de los términos.
-Me reservo el derecho a publicar la obra encargada en línea.Usted (el cliente/comisionado):
-Puede subir la obra encargada a cualquier sitio web y redes sociales.
-NO puede obtener beneficios de la obra encargada (revenderla, redistribuirla, subirla a servicios de impresión bajo demanda, realizar impresiones para su venta, etc.).
-NO puede modificar la obra encargada sin mi consentimiento (el del artista).
-Conservas los derechos de propiedad intelectual (PI).
-NO puedes usar la obra encargada con fines comerciales.
-NO puedes usar la obra encargada con fines de criptoarte.
-NO puedes usar bocetos, trabajos en proceso, obras terminadas o sin terminar para ningún tipo de uso relacionado con IA.Lo siguiente se considera una infracción de derechos de autor:-Reproducir o usar la obra protegida por derechos de autor comercialmente significa lucrarse con ella de cualquier manera no excluida por estos términos.
-Reclamar la obra como propia.
-Alterar la obra sin mi consentimiento.En algunos casos, se pueden adquirir los derechos comerciales de la imagen.Política de cancelación y reembolso-El comprador no tiene derecho a reembolso una vez que comience a trabajar en el encargo.
-Si por alguna razón no puedo comenzar tu encargo, recibirás un reembolso completo.
-Si cancelas antes de que comience, puedes obtener un reembolso completo.
-La tarifa por cancelar el encargo una vez comenzado el trabajo es del 50% del precio del encargo. El cliente recibe el trabajo tal como está. Si el comprador desea cancelar el encargo una vez iniciado el trabajo, puede recibir un reembolso, pero acepta pagar la comisión por cancelación.Especificaciones de PayPal:
-Si recibe un reembolso, no solicite una devolución de cargo a PayPal. La plataforma le permite obtener un reembolso solicitándolo en "¿Necesita ayuda?".
-Si solicita una devolución de cargo a PayPal en cualquier momento en que no se le haya permitido solicitar un reembolso, perderá todos los derechos mencionados anteriormente sobre la pieza encargada y tendré pleno derecho a obtener más beneficios de ella de cualquier manera. Rechazaré la devolución de cargo y proporcionaré a PayPal nuestra conversación sobre el encargo como prueba de que he completado el trabajo para usted. Además, quedará en la lista negra por volver a encargarme.
